As used herein, “you” and “your” refer to you and any organization on behalf of which you are acting. If you are acting on behalf of an organization, you hereby represent that you are authorized to act on behalf of such organization and that your acceptance of these Terms and Conditions creates a legally-enforceable obligation on you and your organization.

A Subscription which grants you access to and use of Membership content in our compliance resource library or to a HIPAA Helper© is contingent on you accepting all of the following Terms and Conditions.  By making a decision to purchase any one (1) year subscription, you hereby acknowledge that you have read, understand, and agree to all Terms and Conditions of use set forth here. If you do not agree to these Terms and Conditions of use, you should not purchase a subscription to any Legal HIE Membership or HIPAA Helper©.

Subject to these Terms and Conditions, you are authorized to access the content applicable to your Subscription SOLELY FOR INTERNAL USE BY YOU ONLY, EITHER AS AN INDIVIDUAL OR AN EMPLOYEE OR AGENT ACTING ON BEHALF OF YOUR ORGANIZATION. You agree to take all necessary steps to ensure that you and your organization abide by these Terms and Conditions. You acknowledge that Legal HIE Solutions LLC holds all copyright, trademark and other rights in the content included with any Subscription. You agree not remove, alter, or obscure any copyright notices or other proprietary rights included in the materials. The scope of your use is determined by the copyright holder.

Any use of content you obtain from Legal HIE not authorized herein is strictly prohibited, including, but not limited to:

1. making electronic or hard copies of any content you obtain from Legal HIE for resale;
2. transferring copies of any of the content to any person or party not bound by these Terms and Conditions (except that limited intra-organization sharing is allowed);
3. creating any modified or derivative work of any of the content you obtain from Legal HIE for any reason other than personal use, or related to your job function at your organization; and
4. making any commercial use of any of the content you obtain from Legal HIE.

All content offered and made available through any Legal HIE Membership subscription or HIPAA Helper© subscription is provided as a general resource only — the tools, policies, forms, and other content provided to you and your organization ARE NOT INTENDED AND DO NOT CONSTITUTE LEGAL ADVICE OR OFFER RECOMMENDATIONS BASED ON THE SPECIFIC CIRCUMSTANCES OF ANY PERSON OR ENTITY.  DO NOT CONSTRUE ANY LEGAL HIE CONTENT AS LEGAL ADVICE.  Legal HIE subscription content SHOULD NOT BE USED TO REPLACE LEGAL ADVICE. Any and all content and information offered through any Legal HIE Membership subscription or a subscription to a HIPAA Helper© is provided “AS IS” WITHOUT WARRANTY of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. LEGAL HIE SOLUTIONS LLC DISCLAIMS RESPONSIBILITY FOR ANY LIABILITY ATTRIBUTABLE TO USE OF ANY OF THE CONTENT PROVIDED. LEGAL HIE SOLUTIONS LLC AND ITS AFFILIATED PERSONS AND AFFILIATED ENTITIES WILL NOT BE LIABLE FOR ANY CLAIMS ATTRIBUTABLE TO ANY ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE INFORMATION, CONTENT OR ANY OTHER MATERIAL CONTAINED ANYWHERE ON THE LEGAL HIE WEBSITE, OR OFFERED THROUGH ANY SUBSCRIPTION. A one (1) year subscription is expressly conditioned upon your acceptance of all the foregoing Terms and Conditions. Acceptance does NOT require your signature; rather, if you proceed to purchase a one (1) year subscription to Membership content or a HIPAA Helper©, your act of subscribing shall be deemed confirmed acceptance of these Terms and Conditions by you, and on behalf of your organization. Your subscription grants you access to the applicable content for one (1) year from purchase of the subscription. NO REFUNDS.  At the end of the year, you can choose to re-subscribe to gain access to new updates and added content.
